Subject Mentoring Service Agreement

This Agreement outlines the terms of engagement between Berleaf Education Pte Ltd ("Provider") and the parent or guardian ("Client"). By enrolling a student into Subject Mentoring — whether through WhatsApp, email, or other means — the Client acknowledges and agrees to the terms below.

1. Services Provided

Berleaf Education offers the following services under this Agreement:

  • Learning Diagnostic — A standalone assessment session to understand the student's learning profile, identify gaps, and prescribe the right growth pathway. This is a separate service and is not part of the Subject Mentoring programme.
  • Subject Mentoring (1-to-1) — Personalised sessions combining academic subject support with coaching in learning habits, mindset, time management, and self-regulated learning.
  • Subject Mentoring (Group) — Small group sessions of 2 to 3 students, recommended where a group dynamic supports the student's growth.

All sessions are 1.5 hours unless otherwise agreed in writing. The specific service, arrangement, and schedule are confirmed during onboarding.

2. Payment Schedule & Method

2.1 Standard Start (beginning of month)

  • Payment for the first two months is required upfront before the first session. A student starting 1 May pays May + June upfront. At the end of May, payment for July is collected. At the end of June, payment for August is collected.

2.2 Mid-Month Start

  • Where a student commences partway through a calendar month, the upfront payment covers the prorated amount for the remainder of the current month, plus one full month ahead. A student starting 15 May pays the remaining half of May (prorated) + June upfront. At the end of May, payment for July is collected. The billing cycle then follows the standard schedule.

2.3 Monthly Billing Cycle

  • From the first full month onward, payment for the month after next is collected at the end of the current month. The Client is always one month prepaid in advance. End of May → pay for July. End of June → pay for August.

2.4 Payment Method

  • All payments are made via PayNow or bank transfer to UEN 202446793D (Berleaf Education Pte Ltd).
  • Sessions are confirmed only upon receipt of payment. An unconfirmed schedule is not a guaranteed slot.

2.5 Session Volume

  • Each Standard Plan is billed for the number of sessions that correspond to the Client's agreed weekly frequency across that calendar month (e.g. once weekly = one session per week that month; most months this is 4 sessions, occasionally 5).
  • This number is not reduced by school holidays or other Client-side unavailability. Affected dates are rescheduled within the month per Clause 3.4, not deducted from the total sessions billed.

3. Scheduling

  • 3.1 Monthly schedules are confirmed at the point of payment, typically by the end of each month for the month after next.
  • 3.2 Clients must inform the Provider of any unavailable dates before the schedule is finalised.
  • 3.3 Once the schedule is confirmed and payment is received, the commitment is binding for that month.
  • 3.4 Dates flagged as unavailable under Clause 3.2 are rescheduled to another available date within the same calendar month, subject to Clause 4 (Postponement). They do not reduce the total number of sessions billed for that month.

4. Postponement

4.1 General Postponement

  • Requests for postponement require a minimum of 7 days' notice prior to the scheduled session.
  • Rescheduling is subject to availability and must be completed within one week of the original session date.
  • A maximum of one (1) reschedule is permitted per calendar month, regardless of reason.
  • Sessions that cannot be rescheduled within the stated timeframe, or where the monthly limit has been reached, are considered used.

4.2 Sick Leave

  • If the student is unwell, the Client must inform the Provider as soon as possible.
  • Sick leave counts toward the one (1) reschedule per calendar month limit.
  • A makeup session will be arranged within one week of the original session, subject to availability.
  • If the monthly reschedule limit has already been used, the session is considered used regardless of reason.

5. Missed Sessions & No-Shows

  • 5.1 Sessions missed without prior notice are considered used immediately.
  • 5.2 All funded sessions that are considered used — whether due to no-show, late cancellation, or exhausted reschedule limit — are non-refundable and cannot be offset against future sessions.

6. Termination & Notice

6.1 Continuation by Payment

  • Payment at each monthly billing date confirms the Client's intention to continue. The programme continues as long as payment is received on time.

6.2 Automatic Termination (Non-Payment)

  • If payment is not received within three (3) days of the billing date, Berleaf Education will treat this as notice of termination.
  • The current funded month becomes the final month of sessions. No further billing will be issued. Billing date is 31 May. Payment must be received by 3 June (3 days from billing). If unpaid by 3 June, June becomes the final month and July sessions will not proceed.
  • Berleaf Education reserves the right to enforce termination with immediate effect upon non-payment, or to reverse this at its sole discretion where otherwise agreed upon between both parties.

6.3 Written Notice by Client

  • The Client may terminate this arrangement by giving written notice via WhatsApp or email at any time.
  • Notice is accepted on a calendar month basis only — not on a rolling 30-day basis.
  • Regardless of the date within the month that notice is given, the full following calendar month is the final month of sessions. Notice given on 15 May → June is the final month in full, all sessions proceed as normal. Notice given on 3 May → same outcome. The date within the month does not change the result.

6.4 No Refunds on Termination

  • All funded sessions within the final month are expected to proceed as scheduled.
  • No refund will be issued for any funded sessions remaining in the final month, regardless of attendance.
  • Sessions missed within the final month remain subject to the standard postponement and missed session policy in Clauses 4 and 5.

6.5 Termination by Provider

  • Berleaf Education reserves the right to terminate this arrangement where the Provider determines it is no longer in the best interest of the student's growth. In such cases, a prorated refund for unused funded sessions will be issued.

7. Media Consent

  • 7.1 Berleaf Education may photograph or record sessions (video or audio) for educational, developmental, or marketing purposes, including use on our website and social media platforms.
  • 7.2 By enrolling in Subject Mentoring, the Client grants Berleaf Education Pte Ltd a non-exclusive, royalty-free licence to use such recordings and images for these purposes.
  • 7.3 If the Client does not consent to photography or recording, written notice must be provided before the first session. Specific sessions may be excluded upon written request.

8. Personal Data Protection

  • 8.1 Personal data collected (including name, contact details, and student information) is used solely for delivering the service, scheduling, billing, follow-up communication, and keeping the Client informed of updates, events, and offerings from Berleaf Education.
  • 8.2 We comply with the Personal Data Protection Act 2012 (PDPA) of Singapore. Your data will not be sold or disclosed to third parties without consent, unless required by law.
  • 8.3 To request access to, correction of, or withdrawal of consent for your data, contact us at berleafedu@gmail.com.

9. Limitation of Liability

  • 9.1 Berleaf Education is not liable for any indirect, incidental, or consequential damages arising from the provision of services.
  • 9.2 Maximum liability is limited to the amount funded for the relevant session or period.

10. Policy Changes

Berleaf Education reserves the right to update this Agreement at any time. The most recent version will always be available at berwinleong.com/tnc. Continued enrolment after any update constitutes acceptance of the revised terms.

11. Governing Law

This Agreement is governed by and construed in accordance with the laws of Singapore.

Learning Workshops — Terms & Conditions

These Terms & Conditions form a legally binding agreement between the parent, guardian, or participant ("You") and Berleaf Education Pte Ltd ("We", "Our", "Us"). By registering for any workshop, you agree to abide by the following terms.

1. Registration & Payment

  • Registration is confirmed only upon full payment and submission of the required registration form.
  • Fees are quoted in Singapore Dollars (SGD) and are non-negotiable unless explicitly stated.
  • Confirmation of participation will be sent via email or WhatsApp within 2 working days of successful registration and payment.

2. No Cancellation, Refund, or Transfer

  • All workshop fees are strictly non-refundable, regardless of the reason for non-attendance.
  • Once confirmed, registration is non-transferable. Substitutions are not permitted.
  • Please ensure availability before completing registration.

3. Rescheduling or Cancellation by Berleaf Education

If Berleaf Education must cancel, reschedule, or postpone a workshop due to circumstances beyond our control (including public health advisories, instructor illness, or venue issues), participants will be notified as early as possible and offered either a full refund or an alternative date.

4. Code of Conduct

  • Participants are expected to arrive on time and conduct themselves respectfully.
  • Berleaf Education reserves the right to dismiss any participant whose behaviour is disruptive or harmful to the learning environment, without refund.

5. Limitation of Liability

  • Berleaf Education shall not be held liable for any loss, injury, or damage sustained during or arising from the workshop.
  • We are not liable for any indirect, incidental, or consequential damages.

6. Data Protection & Privacy

  • Personal data is collected for workshop coordination, follow-up communication, and internal analysis only.
  • We comply with the Personal Data Protection Act 2012 (PDPA) of Singapore.
  • Your data will not be sold or disclosed to third parties without your consent, unless required by law.

7. Media Consent

Berleaf Education may take photographs or video recordings during sessions for educational or marketing purposes (including website and social media). If you do not consent to being photographed or recorded, please notify us in writing before the session.

8. Governing Law

These Terms & Conditions are governed by the laws of Singapore.

Goods & Products Agreement

These Terms and Conditions govern all purchases of physical and digital goods from Berleaf Education Pte Ltd (UEN 202446793D). By placing an order with us, you agree to be bound by these terms.

1. General

Nothing in these Terms and Conditions is intended to limit or exclude any rights you may have under the Consumer Protection (Fair Trading) Act or any other applicable Singapore law.

2. Orders

  • All orders are subject to availability and confirmation of payment.
  • Submitting an order does not constitute a confirmed order. Your order is confirmed only upon receipt of full payment.
  • We reserve the right to cancel any order that remains unpaid within a reasonable period, without prior notice.
  • All prices are stated in Singapore Dollars (SGD), inclusive of applicable taxes unless stated otherwise, and are subject to change without prior notice. Price changes do not affect orders already confirmed.

3. Pre-Orders

  • Payment for pre-order items is collected in advance of the product's availability date.
  • Estimated fulfilment dates are provided in good faith and may be subject to change. Customers will be notified of any significant delays.
  • Pre-order payments are non-refundable if you change your mind after placing the order. If a pre-ordered item cannot be fulfilled by Berleaf Education, a full refund will be issued.

4. Delivery & Collection

  • Self-collection is available at our designated studio location during agreed hours. Details will be communicated upon order confirmation.
  • For mail delivery, orders are dispatched via standard postal services. Once dispatched, Berleaf Education is not liable for delays, loss, or damage caused by third-party postal or courier providers.
  • You are responsible for providing accurate delivery information. Berleaf Education is not responsible for non-delivery resulting from incorrect addresses.
  • Risk of loss or damage passes to you upon dispatch.

5. Digital Goods

  • Digital products are delivered electronically via the method specified at the time of purchase.
  • All sales of digital goods are final once the file has been delivered or the download link accessed. No refunds will be issued except where the file is technically defective and cannot be opened.
  • If you experience a technical issue with a digital product, please contact us within 7 days of receipt.

6. Product Quality

All physical goods supplied by Berleaf Education are warranted to be of merchantable quality and to materially conform to any description provided at the time of sale. This warranty does not apply to damage caused by mishandling, improper storage, or use inconsistent with the intended purpose.

7. Returns & Exchange

  • All sales are final. We do not accept returns or issue refunds except as stated below.
  • If you receive a defective or damaged physical item, please contact us within 7 days of receipt via WhatsApp or email at berleafedu@gmail.com with a description and photograph of the issue.
  • Approved exchanges will be fulfilled subject to stock availability. Where a replacement cannot be provided, a refund for the affected item will be issued.
  • Items returned without prior approval will not be accepted.

8. Intellectual Property

  • All content, materials, and products sold by Berleaf Education — including books, guides, worksheets, and digital resources — are the intellectual property of Berleaf Education Pte Ltd and protected under applicable copyright and intellectual property laws.
  • Purchase grants you a personal, non-commercial licence to use the material for your own learning or that of the individual it was purchased for. You may not reproduce, distribute, resell, or adapt any purchased materials without prior written consent from Berleaf Education Pte Ltd.

9. Personal Data Protection

  • Berleaf Education collects personal data (such as name, contact details, and delivery address) solely for the purposes of processing your order, providing customer support, and communicating about your purchase.
  • We comply with the Personal Data Protection Act 2012 (PDPA) of Singapore. Your data will not be sold or disclosed to third parties without your consent, except where required by law or necessary to fulfil your order.
  • To request access to, correction of, or withdrawal of consent for your personal data, please contact us at berleafedu@gmail.com.

10. Force Majeure

Berleaf Education will not be held liable for any failure or delay in fulfilling an order caused by circumstances beyond our reasonable control, including natural disasters, public health emergencies, postal disruptions, government restrictions, or supplier failures. We will notify you as soon as practicable and either fulfil the order when circumstances allow or issue a full refund.

11. Limitation of Liability

  • Berleaf Education shall not be liable for any indirect, incidental, or consequential loss arising from the purchase or use of our products.
  • Our liability in any dispute is limited to the value of the order in question.

12. Dispute Resolution

In the event of a dispute, both parties agree to first attempt resolution through good-faith communication. If unresolved, the dispute shall be subject to the jurisdiction of the Singapore courts.
